Terms of Service

These Terms of Service (the “Terms”) govern your use of the SmartMoves AI Voice service (the “Service”) operated by Smart Moves Limited (“SmartMoves”, “we”, “us”). By accessing or using the Service you agree to be bound by these Terms.

1. The Service

The Service provides voice-AI infrastructure for call centers including outbound calling, inbound qualification, and related integrations. Service features, capacities, and limits depend on the plan you select.

2. Your account

You are responsible for activity under your account, for maintaining the confidentiality of your credentials, and for ensuring that users you authorize comply with these Terms.

3. Acceptable use

You will not use the Service to (a) violate any law including the U.S. Telephone Consumer Protection Act (TCPA), the FCC regulations on autodialed and prerecorded calls, or any applicable Do-Not-Call regime; (b) place calls without lawful basis or required consent; (c) impersonate any person or entity; (d) interfere with the integrity or security of the Service; (e) resell the Service without a written agreement. You are solely responsible for the lawfulness of your calling activity.

4. Customer content

You retain all rights in the content you upload or generate through the Service (“Customer Content”). You grant us a limited license to host, process, and transmit Customer Content solely to provide the Service. Recordings, transcripts, and dispositions are your data and remain in your tenant.

5. Fees and billing

Paid plans are billed in advance per the pricing page. Per-minute overages are billed at the end of each cycle. We may revise pricing on 30 days' notice; changes take effect at your next renewal.

6. Termination

You may cancel at any time from your dashboard. We may suspend or terminate the Service for material breach, security risk, or non-payment, on reasonable notice where practicable.

7. Disclaimers

The Service is provided “as is”. To the extent permitted by law we disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law our aggregate liability under these Terms will not exceed the fees paid by you in the 12 months preceding the claim. Neither party will be liable for indirect, special, incidental, consequential, or punitive damages.

9. Governing law

These Terms are governed by the laws of Belize. The exclusive venue for disputes is the courts of Belize City unless your local consumer-protection law requires otherwise.
